Terms of Service

These Terms of Service (the "Terms") are a binding agreement between you and Interview Smile LLC ("Interview Smile," "we," "us," or "our") and govern your access to and use of the website located at securemedassist.com and any associated pages operated by us (collectively, the "Site"). SecureMedAssist ("SMA") is a product of Interview Smile LLC.

By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. You confirm that you have the legal capacity and authority to enter into these Terms. If you do not agree, you must not access or use the Site.

1. About the Site

The Site is an informational and marketing website that describes the SecureMedAssist platform, a HIPAA-compliant patient survey and outreach platform built for grant-funded research programs. The Site is provided for general informational purposes only. Nothing on the Site constitutes a binding offer, a warranty of the platform's capabilities, or professional, legal, medical, or compliance advice.

2. Eligibility

The Site is intended for use by professionals evaluating SMA on behalf of healthcare institutions, research programs, and related organizations. It is not directed to children, and it is not intended for use by individuals seeking medical care. By using the Site you represent that you are at least 18 years of age.

3. Relationship to the SMA Platform

The Site does not provide access to the SMA platform and is not used to collect, store, process, or transmit Protected Health Information (PHI) or patient data. Access to and use of the SMA platform are governed by a separate written agreement between Interview Smile LLC and the contracting organization, including, where applicable, a Business Associate Agreement (BAA) entered into under the Health Insurance Portability and Accountability Act (HIPAA). These Terms do not grant any right to use the SMA platform.

4. Acceptable Use

You agree to use the Site only for lawful purposes and in accordance with these Terms. You must not:

  • use the Site in any way that violates any applicable law, regulation, or professional obligation;
  • attempt to gain unauthorized access to the Site, the servers on which it is hosted, or any related systems or networks;
  • probe, scan, or test the vulnerability of the Site, or breach any security or authentication measures;
  • introduce any virus, malware, or other material that is malicious or technologically harmful, or otherwise interfere with the proper working of the Site;
  • use any robot, spider, scraper, or other automated means to access, harvest, or extract data from the Site without our prior written consent;
  • remove, obscure, or alter any proprietary notices on the Site; or
  • submit Protected Health Information (PHI), patient data, or other sensitive personal information through the contact form or any other part of the Site.

5. Contact Form Submissions

The contact form is provided so that prospective customers and institutional reviewers may inquire about SMA. You are responsible for the accuracy of the information you submit. Information you submit is handled as described in our Privacy Policy. You must not submit PHI, patient information, or confidential third-party information through the form. If your inquiry concerns patient data or sensitive compliance details, please indicate this in your message and we will arrange an appropriate secure channel.

6. Intellectual Property

The Site and all of its contents — including text, graphics, logos, icons, images, page layout, design, and the "SecureMedAssist" and "Interview Smile" names and wordmarks (the "Site Content") — are owned by or licensed to Interview Smile LLC and are protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and view the Site for your internal evaluation purposes only. Except as expressly permitted, you may not copy, reproduce, distribute, publish, display, modify, create derivative works from, or commercially exploit any Site Content without our prior written permission.

7. Feedback

If you provide us with suggestions, ideas, or other feedback about the Site or SMA, you grant Interview Smile LLC a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use that feedback for any purpose, including to improve our products and services, without restriction and without any obligation to you.

8. Third-Party Links and Resources

The Site may contain links to websites, resources, or services operated by third parties. We provide these links for convenience only and do not endorse and are not responsible for the content, accuracy, availability, or practices of any third-party site or resource. Your use of third-party sites is governed by their own terms and policies, which you should review.

9. Disclaimers

The Site and all Site Content are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that the Site or its servers are free of viruses or other harmful components. Any statements about the SMA platform on the Site are descriptive only and do not constitute a representation, warranty, or guarantee of performance. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

10. Limitation of Liability

To the fullest extent permitted by law, in no event will Interview Smile LLC or its officers, members, employees, agents, or suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your access to or use of (or inability to use) the Site, whether based in contract, tort (including negligence), strict liability, or any other legal theory, even if we have been advised of the possibility of such damages. To the fullest extent permitted by law, our total aggregate liability arising out of or relating to these Terms or the Site will not exceed one hundred U.S. dollars (US$100).

11. Indemnification

You agree to defend, indemnify, and hold harmless Interview Smile LLC and its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Site, your violation of these Terms, or your violation of any applicable law or the rights of any third party.

12. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect information submitted through the Site. By using the Site, you consent to the practices described in the Privacy Policy.

13. Changes to the Site and These Terms

We may modify, suspend, or discontinue all or part of the Site at any time without notice. We may also revise these Terms from time to time. When we do, we will update the "Last Updated" date above. Changes are effective when posted. Your continued use of the Site after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Site.

14. Suspension and Termination of Access

We may, in our sole discretion and without notice, restrict, suspend, or terminate your access to the Site, in whole or in part, including if we believe you have violated these Terms or applicable law. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.

15. Governing Law and Disputes

These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the United States and of the state in which Interview Smile LLC is organized, without regard to its conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in that state to resolve any dispute, subject to any mandatory consumer-protection rights available to you under applicable law.

16. General

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Interview Smile LLC regarding the Site and supersede any prior agreements on that subject matter. If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign or transfer these Terms without our prior written consent; we may assign them freely. We will not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control.

1. Get in Touch

You can contact us at any time about the way we handle your information — to ask questions, request access to or correction or deletion of your information, opt out of communications, or raise a concern. You can reach us at legal@interviewsmile.com.

2. Scope of This Policy

This Policy applies only to the SecureMedAssist marketing website. It does not apply to the SMA platform itself. The SMA platform processes Protected Health Information (PHI) and patient data under a separate written agreement and Business Associate Agreement (BAA) with each contracting organization, governed by its own privacy terms. No PHI or patient data is collected, processed, or stored through this Site.

3. Information We Collect

We collect the following limited categories of information:

  • Information you provide through the contact form: your full name, organization or institution, title or role, email address, and the contents of your message.
  • Communications: if you email us or otherwise correspond with us, we keep a record of that correspondence.
  • Technical and server log information: like most websites, our hosting infrastructure may automatically record limited technical information necessary to deliver and secure the Site, such as your IP address, browser type, and the date and time of requests. This information is used for security and operational purposes and is not used to build a marketing profile of you.

We do not use analytics platforms, advertising trackers, social media pixels, or other third-party tracking scripts on this Site, and we do not collect information for behavioral advertising.

4. How We Collect Information

We collect information directly from you when you complete the contact form or communicate with us. We collect technical and server log information automatically through our hosting provider when your browser requests pages or assets from the Site. We do not purchase personal information about you from data brokers.

5. How We Use Information

We use the information we collect to:

  • respond to your inquiry and communicate with you about your evaluation of SMA;
  • provide information and compliance documentation you request;
  • operate, maintain, secure, and improve the Site;
  • detect, prevent, and address fraud, security incidents, and technical issues; and
  • comply with our legal obligations and enforce our Terms of Service.

We do not sell or rent your information, and we do not share it with third parties for their own marketing purposes.

6. Legal Bases for Processing

Where the General Data Protection Regulation (GDPR) or similar laws apply, we process your information on the following legal bases: your consent (which you give by submitting the contact form); our legitimate interests in responding to inquiries, operating and securing the Site, and growing our business in a privacy-protective way; and compliance with legal obligations. Where we rely on consent, you may withdraw it at any time by contacting us.

7. Cookies and Third-Party Resources

We do not set advertising or analytics cookies on this Site. The Site loads web fonts from Google Fonts, a content delivery network operated by Google. When your browser requests these fonts, Google may receive your IP address and standard request information as a necessary part of delivering the fonts; Google does not receive any information you enter into the contact form. We do not control, and are not responsible for, Google's processing of that request information, which is governed by Google's own privacy policy. No other third-party resources that receive personal information are embedded in the Site.

8. How We Share Information

We may share your information only in the following limited circumstances:

  • Service providers: with vendors who help us operate the Site and respond to inquiries (for example, hosting and email providers), who are permitted to use the information only to provide services to us;
  • Legal and safety: where required or permitted by law, or to protect the rights, property, or safety of Interview Smile LLC, our users, or others;
  • Business transfers: in connection with a merger, acquisition, financing, or sale of assets, in which case we will require the recipient to honor this Policy; and
  • With your direction or consent.

9. Marketing

We use the contact details you provide primarily to respond to your inquiry. If we send you any informational or marketing communications about SMA, you can opt out at any time using the unsubscribe link in the message or by contacting us at legal@interviewsmile.com. We will not disclose your information to a third party for that third party's own marketing.

10. Data Retention

We retain contact form submissions and related correspondence only for as long as necessary to respond to your inquiry, maintain a reasonable record of our communications, and meet our legal and operational requirements. We then delete or de-identify the information in accordance with our internal retention practices.

11. How We Protect Your Information

We maintain reasonable administrative, technical, and organizational safeguards designed to protect information submitted through the Site against loss, misuse, and unauthorized access, disclosure, alteration, or destruction. The Site is served over encrypted connections (HTTPS). However, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.

12. International Users

The Site is operated from the United States, and any information you submit is processed and stored in the United States. If you access the Site from outside the United States, you understand that your information will be transferred to and processed in the United States, where data protection laws may differ from those in your jurisdiction.

13. Your Privacy Rights

Depending on where you live, you may have rights regarding your personal information, including the right to request access to it, to correct or update it, to request its deletion, to object to or restrict certain processing, and to data portability. Residents of California and certain other U.S. states may have rights under applicable state privacy laws, including the right to know what personal information we collect and to request deletion; we do not sell or "share" personal information for cross-context behavioral advertising as those terms are defined under those laws. To exercise any right, contact us at legal@interviewsmile.com. We will respond within the time required by applicable law and may need to verify your identity before acting on your request. You will not be discriminated against for exercising your rights.

14. No Patient Information

This Site is not intended for the submission of Protected Health Information or patient data. Please do not include patient information in the contact form. If you need to discuss patient data or sensitive compliance details, indicate that in your message and we will arrange an appropriate secure channel.

15. Children's Privacy

The Site is intended for business and professional audiences and is not directed to children under 18. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us and we will delete it.

16. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or for legal, operational, or regulatory reasons. When we do, we will revise the "Last Updated" date above. We encourage you to review this Policy periodically.

For privacy questions, requests, or complaints, contact us at legal@interviewsmile.com. We take your concerns seriously and will work to resolve them. If you are located in a jurisdiction with a data protection authority and are not satisfied with our response, you may have the right to lodge a complaint with that authority.
